Marshall Distribution LLC dba. Primal Health Limited Warranty
Effective Date: October 7, 2025
This Limited Warranty (“Warranty”) is provided by Marshall Distribution LLC (“Company,” “we,” “us,” “our”) to the original purchaser (“Purchaser,” “you,” “your”) of the products specified below.
1. Scope of Warranty
This Warranty applies to new inflatable tubs and smart chillers (“Product”) purchased directly from the Company’s authorized sales channels in the United States, including our official Amazon storefront and Shopify website ([Your Website Address]). This Warranty is granted exclusively to the original Purchaser and is non-transferable.
2. Warranty Period
The Company warrants the Product against Defects (as defined below) in materials and workmanship for a period of one (1) year from the original date of purchase (“Warranty Period”). Proof of purchase is required to validate the Warranty Period.
3. Warranty Coverage
Subject to the terms and exclusions herein, the Company agrees, at its sole discretion, to repair or replace any Product found to have a manufacturer’s defect in materials or workmanship (“Defect”) that arises during the Warranty Period under conditions of normal residential use. This includes functional failures of electronic or mechanical components that are not the result of external causes or improper use.
4. Warranty Exclusions
This Warranty is void and does not cover any damage or failure resulting from, arising out of, or related to:
a. Normal wear and tear, including cosmetic damage such as scratches, dents, or discoloration that does not affect the Product’s functionality.
b. Punctures, tears, or abrasions resulting from improper handling, storage, or use.
c. Abuse, misuse, negligence, accident, or improper installation, maintenance, or operation of the Product contrary to the user manual and official instructions.
d. Unauthorized modification, alteration, or repair performed by any party other than the Company or its authorized service agents.
e. Commercial, rental, or any non-residential use of the Product.
f. Consumable or disposable items, including but not limited to filters, chemicals, and cleaning accessories, unless such items were defective upon initial delivery.
g. Damage caused by external factors such as fire, flood, lightning, acts of God, power surges, or other events beyond the Company's reasonable control.
h. Products for which the original serial number has been removed, altered, or defaced.
5. Sole and Exclusive Remedy
The Purchaser’s sole and exclusive remedy under this Warranty shall be limited to the repair or replacement of the defective Product, as determined at the sole discretion of the Company. The Company may, at its option, use new or refurbished parts for repair or replace the defective Product with a new or refurbished Product of equivalent or superior functionality. Refunds are not a remedy under this Warranty and are governed exclusively by the Company’s standard Return Policy.
6. Warranty Claim Procedure
To obtain warranty service, the Purchaser must follow these steps:
a. Initiate Claim: The Purchaser must initiate a warranty claim by either:
i. Completing the official Warranty Claim Form available at:

b. Provide Information: The claim must include:
i. Proof of Purchase: For Amazon orders, the official order number. For Shopify orders, the email address used at the time of purchase.
ii. A detailed written description of the alleged Defect.
iii. Clear photographic or video evidence of the alleged Defect, if applicable.
c. Authorization: Upon preliminary review, the Company will issue a Return Merchandise Authorization (RMA) number and detailed shipping instructions. Products returned without a valid RMA number will be rejected and returned to the sender at their expense.
d. Inspection: Upon receipt of the Product at our designated facility, the Company will inspect it to determine the nature of the Defect and validate the warranty claim. The Company will notify the Purchaser of the approval or denial of the claim within a reasonable timeframe.
e. Resolution: If the claim is approved, the Company will perform the repair or replacement as described in Section 5.
7. Shipping Costs
a. Within 60 Days of Purchase: For approved warranty claims where the Product is received by the Company within the first sixty (60) days of the original purchase date, the Company will cover all reasonable and standard ground shipping costs, both to and from our facility.
b. After 60 Days of Purchase: For approved warranty claims where the Product is received by the Company after sixty (60) days from the original purchase date, the Purchaser is responsible for all costs associated with shipping the Product to our facility. The Company will cover the cost of shipping the repaired or replacement Product back to the Purchaser.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR PERSONAL INJURY, ARISING FROM OR RELATING TO THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT.
9. Disclaimer of Implied Warranties
THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY THE COMPANY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states or jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.
10. Governing Law and Dispute Resolution
This Warranty shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to this Warranty or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Worcester County, Massachusetts.
BY PURCHASING THE PRODUCT, YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
11. Severability
If any provision of this Warranty is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
